Cooling tower compliance in Hong Kong, in plain language

If your building has a fresh water cooling tower, these are the rules — and the numbers — you need to know.

THE SHORT ANSWER

If your building has a fresh water cooling tower, the EMSD Code of Practice makes you, the owner and duty holder, responsible for keeping it safe: a continuous treatment programme, regular testing, cleaning and disinfection on schedule, and a dated record of every visit. Legionella below 10 cfu/mL counts as “undetected” — that is where a good programme keeps you — and hiring a contractor does not move the legal responsibility off the owner.

The EMSD (Electrical & Mechanical Services Department) regulates fresh water cooling towers in Hong Kong through its Code of Practice for Fresh Water Cooling Towers. The goal is to control Legionella, the bacteria that causes Legionnaires’ disease.

The three numbers to know

  • Below 10 cfu/mL — Legionella at this level counts as “undetected”. This is where a good programme keeps you.
  • 10 to 1,000 cfu/mL — on EMSD's own sample this draws an advisory letter; the Code requires immediate on-line disinfection and a re-test.
  • At or above 1,000 cfu/mL — triggers a statutory nuisance notice and mandatory emergency decontamination. Failing to comply with the notice is an offence.

And one date to know separately: since 2011 the EMSD can enter premises and sample cooling towers at random. You do not get notice.

When a tower receives a nuisance notice, EMSD publishes the building's location. The list is public — your tenants can read it. Keep your building off it.

Who is responsible

The building owner and duty holder. This is the part many people miss: hiring a contractor does not move the legal responsibility off the owner. If the work is not done properly, or the records are not there, the liability stays with you.
